cautious. That’s a necessary consequence of the business they are in. As a result, many banks have made a point of telling dealerships when they’ve noticed possible dis- crimination against minorities over markup amounts. Since the CFPB began examining banks that have indirect auto portfolios, bankers have responded by sending more and more letters to dealers about this potential problem. Sometimes the letter just gives the information to the dealership; sometimes the bank- ers want to meet and talk about the information. Either way, you should pay attention when you get one or more letters of this type. Getting this information is not a nuisance: it’s a help. You didn’t have to pay for it, and it may give you valuable data. Ig- noring something that valuable is a bad idea. Of course, you will want to find out more about it because the bank probably only has a small portion of your business and it may be that when you examine the entire set of contracts, there is no pat- tern of discrimination against any protected group. But it could also be that the bank told you, for free, about something that could really hurt your dealership if you don’t take steps to cor- rect the problem. Know what to say when a bank contacts you It is only human towant to avoid incriminating yourself if your financial institutions contact you about something that could be the start of a serious set of allegations about your auto financing practices. You may worry that you could be set up as the fall guy. Don’t worry. The financial institution will have to deal with any allegations that are brought, which means the financial in- stitution is not in a position to make you look bad; it will have to deal with the problem regardless. All the financial institution wants from you is for you to be interested and to take any appropriate actions that are necessary so that the problem won’t happen again.
